TERMS & CONDITIONS
STUDIO GUIDELINES & HYGIENE:

​If you are experiencing any cold or flu-like symptoms (eg. especially coughing & runny nose), please contact me prior to the training time & refrain from attending. Let's not assume it's allergies & sinuses. We prefer not to spread any unwanted illnesses. ​

A clean, large towel should be brought to every session. When not in use, it is to be stored in your allotted container. Containers are sanitized after each session.

Again, for hygiene purposes, it is preferred that shoes are not worn from outside into the training facility. If this cannot be avoided, ensure that shoes are adequately cleaned before entering.

Persons may wash or sanitize hands upon arrival.

Gloves should be clean. i.e. Gloves shouldn't be used for tire flipping or crawling on the outside and then used to handle equipment inside the studio. Separate gloves can be used in this instance.

Smoking (including e-cigarettes) is not permitted inside of the studio.

PERSONAL POSSESSIONS:

Persons' bags and items are to be placed into the allotted container.

Persons are encouraged to leave all valuable items (which includes jewelry) at home as the Fitness Instructor will not be responsible for holding these items or accountable for lost items.

TRAINING SESSIONS:

All sessions will be conducted at a facility/ facilities agreed upon by you (the Client) and the Fitness Instructor.

If you feel dizzy, faint, unwell or feel any unusual pain then you must stop exercising and inform a member of staff immediately.

You are advised to inform the instructor of any injuries, pains, or concerns prior to the class starting.

The Fitness Instructor reserves the right to deny services if it is deemed that the Client may not be able to exercise safely within the program parameters due to any medical ailment. The Client may be referred to a physician for an in-depth assessment before receiving any fitness instruction in such an event.

If it is evident that the Client’s ability to perform is impaired through drug or alcohol use, the Fitness Instructor has the right to immediately terminate the session.

Clients must provide a minimum of 5 hours' notice to cancel or reschedule a training session. This allows for time to fill a vacated time slot. Cancellation with less than 5 hours' notice will be considered a "late cancellation" and will be charged at the full rate. This also applies if a client does not show up for a scheduled session. If a client needs to cancel or reschedule a session due to an unforeseen emergency or illness, the session will not be considered a late cancellation or no-show.

If there are persistent violations of the Client not being adequately prepared either through nutrition/ hydration, being impaired through drugs/ alcohol, being tardy or persistently canceling training sessions then the Fitness Instructor reserves the right to terminate the contract.

RELEASE

I have enrolled in a program of strenuous physical activity including, but not limited to walking, running, boxing, boxing, weight lifting, aerobics, circuit training, boot camp and use of various conditioning and exercise equipment at the facilities designed, offered, recommended, and/or supervised by the Fitness Instructor on duty. I hereby affirm that I am in good physical condition and do not suffer from any disability that would prevent or limit my participation in this program.

In consideration of my participation in the program, I hereby release Kurt Clarke, his family or heirs from any and all claims, demands or causes of action arising from my participation in the program or from any use of the conditioning and exercise equipment. I hereby release Kurt Clarke, his family or heirs of any and all liability now or in the future, including but not limited to medical expenses, lost wages, pain and suffering, that may occur by reason of heart attacks, strokes, fatality, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/ lower back/ foot injuries, and any other illness, soreness, or injury, however caused, whether occurring during or after my participation in the program.

I acknowledge and agree that this Personal Training Contract is not transferable or assignable. I acknowledge that payment is required for blocks of sessions in advance of actual training sessions. I agree to pay in advance for training sessions unless otherwise agreed upon. I acknowledge that this specific contract, release of liability, consent and agreement is continuously valid indefinitely. No refund will be granted for sessions not completed. I understand that Kurt Clarke has the right and the authority to terminate the program at any time if I do not follow the program or fail to conduct myself in an appropriate manner as previously outlined.
